1. Details of the provider and the purpose of the document

This document governs the online booking of self-drive hire vehicles via the baygo.es website and any other app, device or digital platform owned by AUTO SEXI S.L. (hereinafter ‘BayGo’).

These General Terms and Conditions govern the relationship between BayGo and the customer (hereinafter referred to as ‘the user’ or ‘the hirer’) in relation to the online booking process. The rental agreement itself is formalised at the time of vehicle handover and contains the specific terms and conditions applicable to the particular rental (see clause 14).

By making a booking via baygo.es, the user confirms that they have read, understood and accepted these terms and conditions, as well as the Privacy Policy and the Cookies Policy. If you do not agree with all of them, you must refrain from using the website to make bookings.

BayGo reserves the right to amend these terms and conditions at any time; however, such amendments shall not apply retrospectively to bookings that have already been made. The terms and conditions applicable to each booking are those published at the time of confirmation.

Preliminary information on electronic procurement. In accordance with Article 27 of Law 34/2002 (LSSI-CE), the user is hereby informed that: (i) the booking procedure is carried out entirely electronically via baygo.es, following the steps described in clause 3; (ii) the electronic document formalising the booking will be archived by BayGo and the user may access it by requesting it from info@baygo.es, in addition to receiving a copy in the confirmation email; (iii) before confirming the booking, the user may identify and correct any errors in the data entered by reviewing and amending the summary prior to confirmation; and (iv) the booking may be made in Spanish, notwithstanding that the website may be displayed in other languages.

2. Products available for purchase

BayGo offers two distinct rental products via baygo.es:

Passenger cars. Car hire without a driver for private use. The available rate is the Web Rate (comprehensive cover with no excess), which includes full cover for own damage due to collision and theft, with no excess, plus 24/7 breakdown assistance. It does not cover damage to windows or tyres; these can be covered optionally by taking out Tyres and Glass cover. Mileage is unlimited. Commercial use of the vehicle, the paid transport of passengers or goods, and subletting are prohibited.

Goods vans. Self-drive van hire for transporting your own goods or, in the case of self-employed individuals and businesses, goods related to your business. The available rate is the Goods Rate (comprehensive cover with excess), including 24/7 breakdown assistance. Excess amounts vary depending on the vehicle group (please check the details during the booking process). The excess can be waived by taking out excess-free cover, and damage to tyres and windows can be covered by Tyres and Windows cover, both of which are optional. Mileage is limited to 400 km/day calculated over the total hire period; any excess is charged according to the vehicle group. The following are excluded: paid passenger transport, subletting, and courier or commercial delivery services to third parties.

Important for cargo vans: customers using a debit card as security for the hire must take out excess-free cover. If a credit card is used as security, this cover is optional. Full details of the security policy are set out in clause 5.

The specific terms and conditions for each product (deposits, mileage, liability, damage charges and penalties) are set out in the rental agreement, which is signed upon collection of the vehicle.

3. Booking process

Users can make a booking via baygo.es by following the process outlined on the website, which includes selecting:

  • Location and dates: collection point, and the date and time for collecting and returning the vehicle. The available collection points are displayed during the booking process, depending on the type of product booked.
  • Vehicle: from the range available for the selected period and location.
  • Extras and optional cover: additional insurance, additional drivers, child seats, etc.
  • Details of the hirer and drivers: first name, surname, driving licence, contact details and, where applicable, flight number or point of origin.

Before confirming the booking, the user is shown a full summary containing all the selected details, the total price and the applicable terms and conditions. On this summary screen, the user can identify and correct any errors in the details entered before confirming. The booking is considered finalised when the user expressly confirms their intention to proceed after reviewing this summary.

BayGo will send the user a confirmation email containing the booking details and instructions for collecting the vehicle. If the user does not receive this confirmation within a reasonable time, they should contact BayGo via info@baygo.es.

When collecting the vehicle, the hirer and authorised drivers must present their original, valid identity documents (ID card or passport) and driving licences, as well as the card to be used as security for the hire.

4. Prices, taxes and charges

All prices shown on baygo.es are in euros (€) and include Value Added Tax (VAT) at 21%, as applicable to car hire.

The total price of each booking is determined based on the type of vehicle, the hire period, the collection point, the cover selected and any extras included. This price is shown in detail in the summary displayed before the booking is confirmed.

BayGo reserves the right to change prices and promotions at any time; however, such changes will not affect bookings that have already been confirmed. The price applicable to each booking is the price in force at the time of confirmation.

Fuel. The cost of fuel is not included in the hire price. BayGo applies an ‘equivalent’ fuel policy: the vehicle is handed over with a specific fuel level, which must be maintained when returned. The specific terms and charges for any shortfall in fuel are set out in the hire agreement.

Other charges. Charges arising from the use of the vehicle (penalties, damage, fines, cleaning, administrative fees, etc.) are set out in the hire agreement and are not included in the booking price.

5. Payment methods, deposit and rental guarantees

It is important to distinguish between two separate concepts: the booking payment (which is made when the booking is confirmed via baygo.es or prior to collection of the vehicle) and the rental guarantee (the card that is physically presented at the time of collection as proof of compliance with the contract).

5.1. Payment for the booking

Payment for the booking is made via Stripe’s secure payment gateway. VISA and Mastercard (credit and debit) cards are accepted, as well as digital wallets supported by the payment gateway (Apple Pay, Google Pay and others). The specific availability of each payment method is shown during the payment process.

The gateway employs standard security and encryption protocols to protect the transmission of confidential information. Neither BayGo nor any third parties have access to the full details of the customer’s card or account.

Cards are subject to verification and authorisation by the issuing bank. If the bank does not authorise the payment, BayGo will be unable to confirm the booking and will not be held responsible for any delays resulting from this issue.

In the event of a fraudulent or unauthorised charge, the user may exercise the rights granted to them under current legislation against the issuing bank.

BayGo issues invoices in electronic format. If the user prefers to receive a paper copy, they may request one by emailing info@baygo.es.

5.2. Rental guarantee

Regardless of the payment method used for the booking, the renter must present, at the time of collection, a card to serve as a guarantee of compliance with the rental agreement. The cardholder must be present at the time of collection, even if they are not the renter or the main driver.

The terms of the warranty vary depending on the product purchased:

Passenger cars.

  • If a credit card is provided as security: no deposit will be taken. The card will be designated as the payment method for any justified charges arising from the hire.
  • Using a debit card as security: a deposit of €350 will be held for the duration of the hire.

Goods vans.

  • Using a credit or debit card as security: a deposit of €350 will be held for the duration of the hire.
  • Furthermore, if the deposit is paid by debit card, the tenant must take out comprehensive cover with no excess in order to finalise the contract.

Release of the deposit. The deposit is released once it has been verified that the vehicle has been returned in the condition agreed in the contract and that the hirer has complied with all the terms of the contract. Should there be any justified charges arising from the hire (damage, penalties, fines, cleaning, missing fuel, etc.), these will be deducted from the deposit before it is released. If the charges exceed the retained deposit, the renter undertakes to pay the difference as soon as BayGo notifies them. The details are set out in the rental contract.

6. Collection and return of the vehicle

6.1. Delivery

The vehicle will be handed over to the hirer on the date, at the time and at the collection point specified in the booking. At the time of collection, the following must be presented:

  • A valid, original identity document (ID card or passport) for the renter and all authorised drivers.
  • The original, valid driving licence of the hirer and any authorised drivers.
  • A credit or debit card to be used as a security deposit for the hire. The cardholder must be present when the vehicle is collected, even if they are not the hirer or the main driver.

Failure to provide any of these documents at the time of collection may prevent the contract from being finalised and the vehicle from being handed over, and will not entitle you to a refund of the amount paid.

6.2. Returns

The vehicle must be returned on the date, at the time and to the location specified in the rental agreement, to a duly identified BayGo representative or to a location expressly authorised by the company. The rental period is calculated in 24-hour periods from the exact time of handover.

Fuel policy: BayGo operates a ‘fill-up’ policy; the vehicle must be returned with the same amount of fuel as when it was collected. Charges for any shortfall in fuel are set out in the hire agreement.

Late return: if the vehicle is returned 60 minutes or more after the agreed return time, an additional day’s hire will be charged. If the renter anticipates a delay and does not notify BayGo before the agreed return time, an additional charge of €50 will be applied for administrative costs.

6.3. Replacement of the vehicle

BayGo reserves the right to substitute the booked vehicle with one of the same or a higher category if necessary for operational reasons. In such cases, the agreed terms and conditions will remain in force and the customer will be informed as far in advance as possible.

7. Authorised drivers

Only the hirer and any additional drivers expressly named in the hire agreement may drive the vehicle. All drivers must meet the following requirements:

  • Be at least 21 years of age.
  • Hold a Category B driving licence for at least one year.
  • Please present your original, valid driving licence and ID at the time of collection.

The booking includes one additional driver at no extra cost, provided they meet the above requirements and are named in the contract at the time of collection. Any additional drivers beyond the first will be charged at the current rate.

Allowing an unauthorised third party to drive the vehicle means that the hirer is fully liable for any resulting damage, loss or penalty.

The same driver is not permitted to book multiple vehicles for the same date and time.

8. Cancellation of bookings

The user may cancel a confirmed booking via the contact details set out in clause 15 of this document. The cancellation policy applies equally to passenger cars and vans:

  • Cancellation made more than 48 hours before the agreed collection time: a full refund of the amount paid.
  • Cancellation within 48 hours of the agreed collection time: a penalty of 20% of the booking amount will be charged. The remainder will be refunded to the hirer.
  • No-show (failure to attend without prior cancellation): no refund will be given.

Refunds will be issued via the same payment method used for the booking, within a maximum of 14 calendar days from confirmation of the cancellation.

BayGo reserves the right to cancel a booking if fraud, false information or any other significant irregularity is detected, notifying the user and, where appropriate, issuing a refund.

9. Changes to bookings

The user may request changes to a confirmed booking (change of dates, vehicle, collection point, drivers or extras) via the contact details set out in clause 15 of this document.

Any changes are subject to BayGo’s operational availability at the time of the request. The change is only considered to have been made once BayGo has expressly confirmed to the customer that it is feasible and, where applicable, the customer has paid the corresponding difference.

Conditions applicable to amendments

  • No additional charge, subject to availability. BayGo will process the change free of charge provided that the vehicle and drop-off point are available under the new conditions requested, and provided that the request is made in good time.
  • Price difference (upwards). If the change results in an increase in the rental cost (more days, a higher-category vehicle, additional cover or extras, etc.), the hirer must pay the difference for the change to be considered finalised.
  • Price reduction. If the change involves a reduction in the scope of the booking (fewer days, a lower-category vehicle, etc.), the handling of the difference depends on when the request is made, in accordance with the cancellation policy set out in clause 8: if the change is requested more than 48 hours before the agreed pick-up time, the difference will be refunded via the same payment method used for the booking; if requested within 48 hours prior to the pick-up time, the difference is credited to the customer’s account for future rentals with BayGo. Once the rental has commenced, any reduction in the scope is governed by the early return policy set out in the rental agreement.
  • Requests made at short notice or where no availability exists. If the change is not operationally feasible, BayGo will inform the customer and, where appropriate, offer viable alternatives. Should the customer not accept any of the alternatives, the original booking terms will remain in force.

Contract extensions (additional days beyond the original return date). Once the hire period has begun, any extension is subject to the specific terms of the hire agreement, which require at least 24 hours’ notice prior to the end of the current contract and confirmation of availability from BayGo. The amount paid as a security deposit cannot be used to cover the cost of the extension: the customer must pay the corresponding difference.

10. Right of withdrawal

In accordance with Article 103.l of Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Protection of Consumers and Users, the hire of vehicles for specific dates and times is excluded from the 14-day right of withdrawal applicable to distance contracts.

Consequently, a booking confirmed via baygo.es cannot be cancelled under this right of withdrawal. Cancellations are governed exclusively by the policy set out in clause 8 of this document, and changes by the policy set out in clause 9.

11. Insurance and cover

All bookings made via baygo.es include comprehensive insurance, subject to the specific terms and conditions set out for each product (see clause 2). The applicable cover and exclusions are shown in the summary provided prior to booking confirmation and are set out in full in the rental agreement.

Optional cover available

  • No-excess cover (applicable to goods vans and long-term car hire): this removes the excess in the event of damage caused by a collision or theft.
  • Tyre and Windscreen Cover (applicable to all rates and products): covers damage to the vehicle’s tyres and windscreen during the hire period.

Exclusions common to all policies. Unless the relevant optional cover is taken out, the following are excluded from the insurance: damage to the underbody, roof and interior of the vehicle, windows, wheels and tyres, the theft or misappropriation of personal belongings or the cargo being transported, the loss or misappropriation of vehicle parts (unless theft is proven by a police report) and damage resulting from improper use of the vehicle.

Details of cover, exclusions, excesses and applicable amounts are set out in the rental agreement, which is formalised upon handover of the vehicle. The information regarding cover and exclusions displayed to the user on baygo.es prior to confirming the booking is binding on BayGo. In the event of any discrepancy between this pre-contractual information and the rental agreement, the condition most favourable to the consumer shall prevail.

12. Tenant’s responsibilities

The hirer, together with the authorised drivers, is jointly and severally liable for fulfilling the obligations arising from the hire agreement. The main responsibilities are:

Use of the vehicle. Drive the vehicle with due care, complying with current traffic regulations, without using it for prohibited purposes (paid passenger transport, subletting, competitions, driving schools, professional courier services in the case of cargo vans, etc.) and without driving on unpaved roads, beaches, dirt tracks or any area that could damage the vehicle.

Maintenance. Return the vehicle in the same condition as it was delivered, apart from normal wear and tear. Damage resulting from misuse or negligent driving (engine, clutch, gearbox, underbody, etc.) is not covered by any rate or additional cover and is the responsibility of the hirer.

Fines and offences. The hirer is liable for any fines and penalties arising from the use of the vehicle during the hire period, as well as for the administrative costs incurred by BayGo in identifying the driver responsible to the authorities. The amount of the penalty and the administrative costs are charged to the renter in accordance with the terms of the rental agreement.

Theft, accident or breakdown. In the event of theft, an accident or a breakdown, the hirer must follow the instructions set out in the hire agreement: notify BayGo immediately, report the incident to the authorities where appropriate, submit the police report and return the vehicle keys within the specified timeframe, and not arrange for repairs at their own expense without express authorisation.

Loss of cover. Serious breach of the contractual obligations, driving under the influence of alcohol, drugs or medication that impairs driving ability, use of the vehicle by unauthorised persons, or leaving the permitted territory without authorisation may result in the loss of the cover taken out and the lessee being charged for any resulting damage or expenses.

A full breakdown of the tenant’s responsibilities, as well as indicative amounts for charges and penalties, is set out in the tenancy agreement.

13. Pets, cleaning and other charges

Pets. BayGo allows pets to be transported in its vehicles. The hirer is responsible for taking the necessary measures to ensure that the animal travels safely and without causing significant damage or soiling inside the vehicle. If, upon return, any mess attributable to the transport of pets (hair, odours, stains, faeces, etc.) is found, the cleaning charges set out in the rental agreement will apply.

Vehicle cleaning. The hirer must return the vehicle in a reasonably clean condition. Situations requiring special cleaning (rubbish, significant stains, construction debris, chemicals, etc.) are subject to the charges set out in the hire agreement.

Other charges. The amounts relating to damage, penalties, administrative costs (including the handling of fines and penalties), missing fuel, late returns, leaving the authorised territory and any other charges are set out in full in the rental agreement. By signing this contract, the renter expressly authorises BayGo to charge any justified amounts arising from the rental to the card provided as security or, failing that, to the retained deposit.

Prior notification. BayGo undertakes to notify the hirer in advance, by email or in writing, of any charges incurred after the vehicle has been returned, together with supporting documentation.

14. Relationship between these terms and conditions and the tenancy agreement

These General Terms and Conditions apply exclusively to online bookings made via baygo.es: the vehicle selection process, the terms and conditions applicable to the booking, payment, amendments, cancellations, and the user’s rights and obligations prior to vehicle collection.

The rental agreement itself is drawn up in writing at the time the vehicle is handed over, whether at a BayGo office, at the agreed handover point or at any other location authorised by the company. This contract governs the relationship between BayGo and the hirer during the period of use of the vehicle and contains the specific terms and conditions applicable to the particular hire: detailed insurance and cover, deposits, indicative amounts for damage and penalties, fuel policy, vehicle return, accidents, theft, early return, permitted territory and other operational conditions.

The pre-contractual information provided to the user on baygo.es prior to confirming the booking forms part of the contract and is binding on BayGo in accordance with Articles 61 and 65 of Royal Legislative Decree 1/2007. In the event of any discrepancy between the provisions of these terms and conditions or the aforementioned pre-contractual information and the rental contract, the provision most favourable to the consumer shall prevail.

By signing the tenancy agreement, the tenant confirms that they have read, understood and accepted both these terms and conditions and the specific terms of the agreement.

15. Customer service, complaints and dispute resolution

Complaint forms. BayGo has official complaint forms available to consumers and users at its offices, in accordance with Decree 472/2019 of the Regional Government of Andalusia. They can also be requested via the contact details provided.

Handling of complaints. Complaints will be dealt with by BayGo’s customer service team as quickly as possible and, in any event, within the legally prescribed time limit. Each complaint will be registered with a reference number, which will be provided to the customer so that they can track its progress.

Alternative dispute resolution

  • Alternative dispute resolution for consumer disputes. In accordance with Directive 2013/11/EU and Law 7/2017, which transposes it into Spanish law, consumers may refer matters to accredited alternative dispute resolution bodies for consumer disputes. Information regarding the competent body or bodies may be requested via support@baygo.es.
  • Consumer Arbitration Scheme. Consumers may refer any dispute to the Consumer Arbitration Scheme once BayGo has joined the scheme. Information regarding BayGo’s membership of this scheme and, where applicable, the relevant arbitration bodies, may be requested via support@baygo.es.

Applicable law and jurisdiction. The relationship between the user and BayGo is governed by current Spanish legislation, in particular Royal Legislative Decree 1/2007 (General Law for the Protection of Consumers and Users), Law 34/2002 (Information Society Services and Electronic Commerce) and other supplementary regulations. In the event of a dispute, the parties may submit their differences to arbitration or bring the matter before the ordinary courts in accordance with the applicable rules on jurisdiction and competence. Where the user is a consumer, the court corresponding to their place of residence shall have jurisdiction.

16. Other provisions

Changes to the terms and conditions. BayGo reserves the right to amend these General Terms and Conditions at any time; however, such amendments shall not apply retrospectively to bookings that have already been made. The terms and conditions applicable to each booking are those published on baygo.es at the time of confirmation.

Written communications. The user expressly agrees that communications between the parties shall be made by electronic means (email or notices on baygo.es), in all cases complying with the legal requirements for written evidence.

Assignment of rights and obligations. The user may not assign, convey or transfer the rights or obligations arising from their booking without BayGo’s prior written consent. BayGo may assign or transfer the rights or obligations arising from these terms and conditions, without this affecting the consumer’s rights recognised by law.

Force majeure. BayGo shall not be liable for any failure to perform or delay in performing its obligations where such failure or delay is due to force majeure (strikes, civil unrest, terrorist attacks, natural disasters, epidemics, the inability to use transport or telecommunications, acts of public authorities, etc.). The obligations affected shall be suspended for the duration of the force majeure event.

Partial invalidity. If any provision of these terms and conditions is declared null and void or unenforceable by a final court ruling, the remaining provisions shall remain in force and shall not be affected by such a declaration.

Intellectual and industrial property. All content published on baygo.es (text, images, trademarks, logos, designs, source code, etc.) is the property of BayGo or of third parties who have expressly authorised its use. Its reproduction, distribution or exploitation without express authorisation is prohibited.

Entire Agreement. These terms and conditions, together with the rental agreement and the documents expressly referred to therein, constitute the entire agreement between the parties in relation to the online booking and the rental of the vehicle, and supersede any prior oral or written agreement, understanding or promise.
